Terms and Conditions for Airtime Moments Services
1. Introduction These Terms and Conditions govern the services provided by Airtime Moments ("we", "us", or "our"). By engaging our services for photography and videography, the client ("you", "your", or "Client") agrees to the following terms.
2. Services We offer a range of photography and videography packages. Each package’s specific details, such as duration of coverage, number of photographers/videographers, deliverables (e.g., number of edited images, length of video), and delivery timelines, will be specified in the service agreement provided at the time of booking.
3. Booking and Payment
A deposit of 20% is required to secure your booking date. This deposit is non-refundable.
The remaining balance must be paid in full no later than 14 days before the event date.
4. Cancellation and Postponement
Cancellations must be made in writing.
If a cancellation is made less than 30 days before the event, the client is responsible for 50% of the total contract value.
If a cancellation is made more than 30 days before the event, only the deposit will be retained.
Postponements can be accommodated based on availability, without penalty if notified at least 30 days before the original event date.
5. Intellectual Property
All intellectual property rights in the images and footage remain with Airtime Moments.
Clients receive a limited license to use the images and footage for personal use only, unless otherwise agreed upon in writing.
6. Delivery
Digital images and video content will be delivered through an online gallery or via digital download within 12 weeks after the event.
Physical products (e.g., prints, USB drives) will be delivered within the agreed upon time from both Airtime Moments and client from the date of final payment.
7. Liability
Airtime Moments will not be liable for any indirect or consequential loss, damage, or expenses (including loss of profits, business or goodwill) that arise from our services.
In the event of unforeseen equipment failure or event circumstances beyond our control, our liability shall be limited to a refund of all payments received.
8. Force Majeure
Neither party will be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party.
9. Amendments
These Terms and Conditions may be amended from time to time and the latest version will always be posted on our website.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of NSW, Australia.
